While you may have lost your home, there's no need to forfeit your hard-earned equity. What can we do for you?

  • We communicate with the county’s department related to your foreclosed property and all needed documentation to file the claim on your behalf.
  • We communicate with the local attorney specialized in these kind of cases to address the pending issues related to your foreclosed property.
  • We expedite the claim process with our expert legal team to insure that every dollar owed by the county to you is fully addressed and refunded back to you. We work diligently to insure the process to go as smoothly as possible, at NO cost to you (if there is no funds left from the foreclosure process, there is NO cost or financial obligation to pay a penny to anyone, including county. The whole process of filing the claim is FREE to you)

Due to tax-related matters, your home has been seized by county officials. The value of your home far exceeds the unpaid taxes. Unfortunately, counties typically do not take the necessary steps to notify the homeowners about any surplus owed to them once the foreclosure process concludes. Our responsibility is to ensure you are informed, particularly in light of the recent federal law prohibiting counties from withholding extra funds owed to homeowners. We take the initiative to file a claim, ensuring that all amounts due to homeowners are fully paid to them.

Tax overages, also known as excess funds or surplus funds, occur when a property is sold at a tax sale for an amount that exceeds the delinquent taxes owed. Here's how it typically works: 1. Tax Sale: When a property owner fails to pay property taxes, the local government may hold a tax sale or auction to recover the unpaid taxes. Interested buyers, often investors, bid on the property, and the property is sold to the highest bidder. 2. Excess Funds: If the property sells for an amount that surpasses the delinquent taxes, penalties, and fees, the excess funds, or tax overages, are generated. These funds are the difference between the winning bid and the total amount owed to the government. 3. Claiming the Overages: In some jurisdictions, there is a waiting period for the former property owner to claim the surplus funds. If the owner doesn't come forward within a specified time, the funds may be considered unclaimed property. 4. Overage Advocate Services: We specialize in helping homeowners claim these surplus funds. We identify cases where property owners are unaware of the overages and help them navigate the legal process to retrieve the funds. 5. Legal Regulations: Laws regarding tax overages vary by jurisdiction. In recent times, there has been increased attention to ensuring that property owners are informed about any surplus funds owed to them, and regulations have been put in place to prevent governments from keeping these funds. Tax overages represent the extra funds generated when a property is sold for more than the delinquent taxes owed. Understanding and claiming these overages can provide financial relief to property owners who may have lost their property due to tax foreclosure.

All FAQ

Where does this money come from?

When a property is sold at auction, sometimes it sells for more than what is owed to creditors and lien holders. We believe the difference should go back to the homeowner or their heirs. If this money is not claimed within the strict deadlines set by each state, then the money is forfeited to the government and cannot be recovered.

Where is my claim being held and how much is it?

Since we don’t charge an upfront fee, it is our policy to not disclose the location of the funds until an agreement is signed. Once our contingency fee agreement is signed, we will gladly disclose the location of the funds, file the claim and keep you notified throughout the whole process.

Why do I need to use your company to find my money?

The government agencies that are holding the funds don’t post these online and will not show up in an internet search. There are state websites that list unclaimed funds but these are not the funds that we have discovered. If you don’t use a professional service like ours and try to find it yourself, there is a slim chance you will find it on your own. You could always file a law suit in court against someone as well on your own, however you’re more likely to get a good result using an Attorney. Same principles apply when trying to claim these funds.

How long does the whole process take to receive the money?

Each government agency has different procedures and timelines. Depending on the agency and the type of claim, it can take as little as 90 - 120 days from the filing date to receive the funds. At the moment we are seeing the process is taking a little longer than normal due to Covid-19.

How do I start the recovery process?

Contact Overage Advocates by phone or email and a representative will discuss your claim in more detail and send the paperwork out to you to be signed. Once we receive all the paperwork back, then we will put your claim package together and file it with the proper agency within 48 hours. We will keep you informed throughout the entire process until the money is in your hands.
